1. Acceptance
By accessing mg5webapp.com or engaging MG5 Studio for services, you agree to these terms. If you do not agree, please do not use the site or our services.
2. Services
MG5 Studio provides web development, app development, and website management services to South African and international businesses. Specific deliverables, timelines, and fees are agreed in a separate written proposal or service agreement for project work.
3. Website management plan
The monthly management plan (currently R299/month) is billed on a recurring basis via PayFast. It covers the services listed on the Subscribe page at the time of sign-up. You may cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.
4. Consultation booking
A R500 once-off fee secures your strategy session slot. This fee is non-refundable if you cancel within 24 hours of the scheduled time or do not attend. If we need to cancel, we will offer a full refund or reschedule at your preference.
5. Payment
All prices are in South African Rand (ZAR) and exclude VAT unless stated otherwise. Payments are processed by PayFast. We do not store card details. Outstanding invoices for project work are due within 14 days of issue. Late payments may attract interest at the prime lending rate.
6. Intellectual property
Upon receipt of full payment, you own the custom code and assets we create specifically for you. We retain ownership of any pre-existing tools, frameworks, and libraries we use, subject to their respective open-source licences. We reserve the right to display completed work in our portfolio unless you request otherwise in writing.
7. Client responsibilities
You are responsible for providing accurate project briefs, timely feedback, and any third-party credentials or content we need to complete your project. Delays caused by late client feedback may extend agreed timelines.
8. Limitation of liability
To the maximum extent permitted by South African law, MG5 Studio's total liability for any claim arising from our services is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, consequential, or loss-of-profit damages.
9. Governing law
These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
10. Changes
We may update these terms from time to time. We will notify active subscribers by email of material changes at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance.
